![]() ![]() Only Belgium has worse figures in the EU. Inflation is running rampant, in fact, it is the highest in 70 years and exceeded 10% in September, according to Eurostat data. In Berlin, as is evident, a climate of nervousness has set in that has been paralysing the executive. Its industry depends on supplies flowing at the usual rate, a need that is of course not being met in this context. Germany, the eurozone's largest economy, is in the grip of Russian gas. But it is likely to happen in the coming weeks. So far they have not stopped despite the war and Gazprom's threats on Naftogaz, the Ukrainian state energy company. Around 80% of the supply even comes via the Yamal-Europe, Brotherhood or Soyuz pipelines, which pass through Ukraine. Until just a few weeks ago, it also came via the Baltic Sea, before the Nord Stream 1 and 2 pipelines were sabotaged, which has led to an escalation of tensions in the region. It comes via Slovakia, the Black Sea, Turkey and Bulgaria. Russian gas, however, continues to arrive in dribs and drabs. Brussels is now speeding up the process of energy disconnection to reduce this percentage. At least 40% of the gas consumed by member states in 2021 came from Russia. Gas as a tool of pressure: this is how Moscow has taken advantage of Europe's energy dependence to tighten the screws within the EU-27. Far from abating, the price rises are constant due to the shortages caused by the Kremlin's supply cuts. It will verify the actual ability to challenge the execution of an EAW in the executing state, as well as the ability to challenge the issuing of an EAW before or after surrender.Natural gas prices have reached an all-time high in the third quarter of the year. STREAM will examine the extent to which the right to an effective remedy/effective judicial protection and EU procedural rights are ensured in EAW proceedings. Reasons behind MS difficulties in complying with mandatory time limits will also be identified and assessed.Īccess to effective remedies pre and post surrender It will assess whether decisions not to recognise or execute EAWs are in line with CJEU jurisprudence, as well as whether such decisions are justified by the need to ensure respect for fundamental rights. STREAM will collect and compile information related to recognition and/or execution decisions and assess whether they are in line with existing EAW case law and policy guidance. ![]() It will also verify the adherence of such assessments to available guidance on the use of the EAW. It will study how assessments related to proportionality, determination of case “trial readiness”, and recourse to instruments other than the EAW such as the European Investigation Order are performed in 14MS. ![]() STREAM will clarify the level of judicial protection required for issuing and validating EAWs. STREAM will increase consistency in:ĮAWs issuing, validation, and proportionality assessments It will also explore solutions that could hep overcome difficulties in securing procedural rights and access to remedies in both the issuing as well as the executing MS. STREAM research and analysis will allow the development of the guidance and training needed to coherently interpret and apply the normative and jurisprudential standards governing each phase of different EAW proceedings. In-depth legal analysis on the uses of the EAW will be performed by leading criminal law scholars in 14 Member States and complemented with EU-wide practitioners’ consultations to provide the evidence needed to consistently tackle key questions and challenges affecting the use of the EAW. STREAM will monitor and examine EAW-related jurisprudential developments across the EU. STREAM will increase mutual trust among judicial authorities and lawyers participating in surrender procedures by means of: fostering consistency and coherence in the use of the EAW, and promoting a streamlined understanding of the criminal justice rules and safeguards applicable to the surrender of persons in a post-Lisbon Treaty setting. ![]()
